This website is owned and operated by Young Artists Community Ballet, Inc., d/b/a Ballet Continental (“Ballet Continental,” “we,” “our,” or “us”), a registered nonprofit corporation. By accessing or using our website, purchasing merchandise, donating, or registering for classes, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our site.

1. Eligibility and Accounts

  • Minors: Our dance classes serve minors, but user accounts must be created by a parent or legal guardian over the age of 18.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account.
  • Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

2. Class Registration and Third-Party Services

  • Class Registration: Online class enrollment, scheduling, and tuition management are processed via our secure third-party provider, Jackrabbit Dance. By initiating registration on this site, you will be redirected to our portal powered by Jackrabbit Dance.
  • Incorporation of Portal Waivers: During the enrollment process within the Jackrabbit Dance portal, parents or legal guardians are required to review and digitally accept specific legal agreements, including the “Assumption of Risk,” “Release of Liability,” “Medical Emergencies,” and “Payment” policies.
  • Binding Agreement: You acknowledge and agree that those portal waivers are fully incorporated into these website Terms of Service by reference. Digitally signing those policies within the Jackrabbit portal forms a legally binding contract between you and Ballet Continental that applies to all classes and performances.
  • Schedule Changes: We make every effort to keep class schedules accurate. However, we reserve the right to change schedules, substitute instructors, or cancel classes due to low enrollment or unforeseen circumstances.

3. Tuition, Payments, and Refunds

  • Fees: All tuition fees, performance fees, and costume fees are detailed on our tuition and fees page.
  • Refund Policy: Tuition is non-transferable and non-refundable unless a class is cancelled due to low enrollment, in which case a full refund will be issued. To withdraw from a class, send us a written notice before the first day of the month to avoid being charged. No refunds will be issued for mid-month withdrawals.

4. Donations and Nonprofit Status

  • Tax Deductibility: Young Artists Community Ballet, Inc. is a registered 501(c)(3) nonprofit corporation, EIN 86‑0669212. Donations made through our online form are generally tax-deductible to the extent permitted by law.
  • Receipts: Official tax receipts will be emailed to the address provided during the donation process.
  • Finality of Donations: All donations are final and non-refundable unless a clerical error occurred, which must be reported within 30 days.

5. Online Store and Merchandise

  • Product Pricing: We reserve the right to change prices for products in our online shop at any time or correct pricing errors that may inadvertently occur.
  • Shipping & Fulfillment: Shipping times are estimates and not guarantees. We are not responsible for delays caused by shipping carriers.

6. Intellectual Property

  • Ownership: All content on this website, including logos, text, dance class descriptions, and photos, is the property of Ballet Continental or has been licensed to us by its creator, and is protected by copyright laws.
  • Usage Restrictions: You may view and share links to our photos for personal, non-commercial use. You may not download, copy, modify, or reuse any performance photos for commercial purposes without explicit written consent.

7. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using this website, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Service by reference.

8. Limitation of Liability

To the maximum extent permitted by law, Young Artists Community Ballet, Inc. and its directors, employees, and agents shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the website, software downtime, or errors in website content, even if we have been advised of the possibility of such damages.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by updating the “Last Updated” date at the top of this page. Your continued use of the site after changes are posted constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles.
